Terms of Use
These Terms of Use (the “Terms”) set out the conditions for using the app “YOBIOKO” and the website “yobioko.net” (the “Service”) provided by Hugbit (the “Operator”). By using the Service, you are deemed to have agreed to these Terms.
Article 1 (The Service)
The Service provides an alarm that you stop by typing the tasks you have registered, analysis of your typing records, the 16 Morning Types test and related features.
Article 2 (Fees)
The Service is free to start. Some features are available with the paid subscription “YOBIOKO Premium” (“Premium”).
Article 3 (Premium)
- Price and period: Premium is a subscription of ¥400 per month (tax included, in Japan) that renews automatically every month. Prices differ by country and region; the amount shown on the purchase screen applies.
- Payment: Your Apple ID (App Store) or Google account (Google Play) is charged when the purchase is confirmed.
- Auto-renewal: The subscription renews automatically unless you cancel at least 24 hours before the end of the current period on the App Store, or before the next renewal date on Google Play.
- Cancellation: You can cancel anytime from Settings → your name → Subscriptions on iPhone, or from “Payments & subscriptions” in the Google Play Store on Android. After you cancel, you can keep using Premium until the end of the period you have paid for.
- Free trial: If a free trial is offered and you do not cancel during the trial, it switches automatically to a paid subscription when the trial ends.
- Refunds: Refunds follow the rules of Apple or Google. The Operator cannot issue refunds directly.
- Restoring purchases: When you change devices, you can restore Premium with the same account from “Restore purchase” in the app.
- The features included in Premium may be added to or changed for improvement.
For apps obtained from the App Store, Apple's Licensed Application End User License Agreement (EULA) applies in addition to these Terms.
Article 4 (Important notice about alarms)
Alarms may fail to ring or may ring late because of device settings (notification and alarm permissions, volume, Focus modes, battery-saving features and so on), remaining battery, or OS behavior or bugs. The Operator does not guarantee that alarms will always ring. When oversleeping could cause serious loss, such as before an exam, an interview or a flight, please use another alarm as well.
Article 5 (Prohibited acts)
When using the Service, you must not:
- act against laws or public order and morals;
- interfere with the operation of the Service or gain unauthorized access;
- modify, analyze (including reverse engineering), copy or redistribute the Service;
- use paid features by improper means;
- infringe the rights of other users or third parties.
Article 6 (Intellectual property)
Rights to the text, images, characters, programs and other content in the Service belong to the Operator or the rightful owners.
Article 7 (Ads)
Third-party ads are shown in the parts of the Service that are free to use. The Operator is not responsible for the content of ads or for the services you reach from them.
Article 8 (Changes to and suspension of the Service)
The Operator may change the Service, or suspend or end it, with prior notice (or with notice afterwards in an emergency).
Article 9 (Disclaimer)
- The 16 types test, scores and analysis are for self-understanding and enjoyment, and are not a medical or psychological diagnosis.
- The Operator is not liable for damage arising from use of the Service, except in cases of the Operator's intent or gross negligence.
- Even where the Operator is liable, its liability is limited to the Premium fee you paid in the month in which the damage occurred. This does not apply where the limitation is not permitted under the Consumer Contract Act of Japan or other laws.
Article 10 (Changes to these Terms)
The Operator may change these Terms when necessary. The changed Terms take effect when they are posted on this page. If there is an important change, we will announce it in the app or on this page.
Article 11 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. Any dispute relating to the Service is subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
